If you’re an employer looking to avoid the LMIA process or a foreign worker with a Canadian job offer we recommend assessing if NAFTA offers a viable category to come to Canada

We focus on two of the four categories currently under NAFTA.

Professionals

To be eligible for this category, the foreign worker must:

  • Be a citizen of USA or Mexico
  • Have proof of a pre-arranged employment including details of the position and educational qualifications
  • Be coming to Canada to work in an eligible occupation

Listed occupations are specific. Please refer to our article (here)

Intra-Company Transferees

To be eligible for this category, the foreign worker must:

  • Be a citizen of USA or Mexico
  • Be transferring to a Canadian enterprise that is a parent, branch, subsidiary or affiliate to the Mexico or USA company
  • Be currently employed in a similar position outside Canada and for at least one year in the three-year period
  • Have a job offer for an executive, managerial or specialized knowledge role
